Accused No.9 in Crime No.55/2026 registered by Konanakunte Police Station, Bengaluru City for the offence punishable under Sections 316(1), 318(2), 61(2) & 336(3) of BNS, 2023 is before this Court seeking anticipatory bail. 2. Heard the learned counsel appearing for the petitioner and learned Addl. SPP on behalf of respondent - State. 3. FIR in Crime No.55/2026 was registered by Konanakunte Police Station, Bengaluru City for the aforesaid offences on the basis of first information dated 20.02.2026 received from Sri D Kumaresh, who is the authorized representative of the Finance Company Repco Home Finance Ltd., In the said FIR, petitioner is arraigned as accused no.9. Apprehending arrest in the said case, the petitioner had filed petition before the jurisdictional Sessions Court in Crl.Misc.No.2289/2026, which was heard - 3 - HC-KAR NC: 2026:KHC:25461 CRL.P No. 6208 of 2026 and rejected on 01.04.2026. Therefore, he is before this Court. 4. Material on record would go to show that, the petitioner is working as Branch Manager of the complainant company. The allegation in the first information which was submitted by the authorized representative of the finance company in which the petitioner was working as a Branch Manager is that accused nos.1 and 2 had borrowed loan from the company for purchase of property bearing plot No.1, Ward No.3, Sy.No.34/2 situated at Chikkabettahalli Village, Yelahanka Hobli, Bengaluru and the petitioner, who was Manager of the complainant company had sanctioned a loan of Rs.45,00,000/- to accused nos.1 and 2. According to the complainant, accused nos.1 and 2 in collusion with accused nos.3 and 5 had created fraudulent document and based on the same, aforesaid loan was availed. 5. Perusal of the material on record would go to show that, the documents which were submitted by - 4 - HC-KAR NC: 2026:KHC:25461 CRL.P No. 6208 of 2026 accused borrowers for the purpose of availing loan was forwarded to the panel advocate of the complainant company, who is arraigned as accused no.7 in the present case and the property was also valued by a panel valuer, who is arraigned as accused No.8 6. Learned counsel for the petitioner submits that it is only based on the legal opinion received from panel advocate and also valuation report received from panel valuer, the petitioner who was working as a Branch Manager of the company had sanctioned the loan. He also submits that the petitioner is ready and willing to cooperate with the investigating officer and has undertaken to abide by any conditions that may be imposed by this Court. 7. The alleged offences in the present case are all triable by the Court of Magistrate and the maximum punishment for the alleged offences is imprisonment for a period of seven years. - 5 - HC-KAR NC: 2026:KHC:25461 CRL.P No. 6208 of 2026 8. Considering the aforesaid aspects of the matter and also the having regard to the allegation made against the petitioner, the prayer made by the petitioner for grant of anticipatory bail needs to be granted subject to appropriate conditions. 9. Accordingly, the following: ORDER The Criminal Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.55/2026 registered by Konanakunte Police Station, Bengaluru City for the offence punishable under Sections 316(1), 318(2), 61(2) & 336(3) of BNS, 2023 subject to the following conditions: 1. The petitioner shall appear before the Investigating Officer in the present case within a period of two weeks from the date of receipt of certified copy of this order on executing a personal bond for a sum of - 6 - HC-KAR NC: 2026:KHC:25461 CRL.P No. 6208 of 2026 Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court. 2. The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. The petitioner shall not tamper with the prosecution witness and he shall co-operate with the Police for investigation and appear before them whenever called upon. 4.
