2026:JHHC:5364 IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 310 of 2026 ----- Dibyansh Jha @ Dibyansh Ranjan Jha, S/o Rakesh Ranjan Jha, R/o Bawanbigha (Ambe Garden), P.O. & P.S. Kunda, Dist- Deoghar .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Pran Pranay, Advocate For the State : Mr. Naveen Kr. Gaunjhu, AddI. P.P. …...... 02/24.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 103(1) & 3(5) of the Bharatiya Nyaya Sanhita and 27 of Arms Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned A.P.P. opposes the prayer for bail. 4. From the F.I.R., I find that petitioner and others were quarrelling amongst themselves, when the son of the informant and the informant reached the place of occurrence. It is stated that thereafter on the instigation of Priya Pandey, one of the accused shot at the deceased, who later on was declared dead. Informant is the eye witness, but admittedly, as per the materials available on record, it is not this petitioner, who had shot at the deceased. The allegation against this petitioner is that he was quarrelling with others 5. Considering the fact that there is no allegation of firing by this petitioner, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Deoghar in connection with Kunda Police Station Case No.212 of 2025 subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his own name within the State of Jharkhand.
