02/30.06.2026 Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Pirtand P.S. Case No. 03 of 2026, registered for the offence under Sections 191(1), 126(1), 115(1), 118(1), 109(1), 76, 351 and 352 of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Additional Chief Judicial Magistrate, Giridih.

Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in the case and there are case and counter case between the parties. He next submits that the altercation took place due to the land dispute and both the sides are agnates. On these grounds, he submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State and the informant jointly oppose the prayer and submit that there is direct allegation of assault upon the sister-in-law of the informant, pursuant to that she has received grievous injury. On these grounds, he submits that anticipatory bail may kindly be rejected.
5. In the FIR, there is direct allegation against the petitioner nos.1 and 2 of assault, pursuant to that sister-in-law of the informant has
2026:JHHC:18994 received grievous injury, in the attending facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner nos.1 and 2.
6. Accordingly, the prayer for bail of petitioner nos.1 and 2, is hereby rejected.

So far petitioner nos.3 and 4 are concerned, there are general and omnibus allegation against them and the altercation took place due to the land dispute and there are case and counter case between the parties and it has been pointed out that some of the accused persons in the case lodged by the petitioner side, have been granted anticipatory bail, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner nos.3 and 4.

Accordingly, the petitioner nos.3 and 4 are directed to surrender before the learned court within two weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Giridih, in connection with Pirtand P.S. Case No. 03 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
