CORAM: HON’BLE MR. JUSTICE RAJESH SEKHRI, JUDGE
ORDER
19.01.2026
01. The petitioners having attained the age of majority have entered into wedlock out of their free will and volition. Petitioners have placed on record their respective Date of Birth Certificates, issued by the competent authorities. The petitioners, however, apprehend danger to their matrimonial life at the hands of private respondents.
02. It is trite in law that any person having attained the age of consent is entitled to marry as per his/her choice and the Government, in particular the police agency is under an obligation to protect the life of its citizens. It appears that petitioners have not approached the official respondents for indulgence in the matter.
03. Having regard to the limited nature of controversy and the relief prayed for, the present petition is admitted to hearing at its threshold and is disposed of by providing that official respondents shall look into the grievance of the petitioners for adequate security cover to make sure that nobody is allowed to interfere in their matrimonial life, provided there is no legal impediment.
04. It is made clear that this Court has not expressed any opinion about validity or authenticity of the marriage and the documents/certificates annexed with the petition and this order shall not come in the way of the police agency for investigation of FIR/criminal complaint, if any, filed against the petitioners.
05. The writ petition is accordingly disposed of.
06. Copy of this order be furnished to both learned counsels for the petitioners and Mr. Bhanu Jasrotia, learned GA, under seal and signature of the Bench Secretary. Learned GA shall immediately convey this order to the concerned SHO, who in turn shall ensure the compliance in letter and spirits.
