The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to call for the records of the case of the State for kind perusal of this Hon’ble Court. 10.2 That, this Hon’ble Court may kindly be pleased to issue an appropriate writ, order or direction directing the respondents to grant the benefit of the Vth Pay Commission/Revised Pay Scale to the petitioner in terms of the order dated 07.07.1998 as mentioned in Service Records of the Petitioner (Annexure P/3). 10.3 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to continue granted Vth Pay Commission/revised pay scale granted to the petitioner order dated 07.07.1998. 10.4 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to extend all consequential benefits, including fixation of pay and payment of arrears arising out of the Vth Pay Commission and revision pay order dated 07.07.1998.” 2. Learned counsel for the petitioner submits that the Respondent No. 5 has issued a letter dated 05.08.2021 mentioning recovery of a sum of Rs. 83,040/- on the ground that the petitioner has been paid excess amount by wrongly extending the benefit of time pay-scale. The letter dated 05.08.2021 was put to challenge in writ petition bearing WP (S) No. 752/2025 seeking relief of quashment of said letter. The writ petition was allowed and the said letter of recovery dated 05.08.2021 issued by the respondent authorities for recovery of the aforesaid excess payment was set-aside, however, the respondents are not granting the benefit of time pay-scale which was given to the petitioner on 09.08.2021 and therefore, the petitioner has filed this writ petition. 3. He also contended that the petitioner was getting benefit of time pay- scale with effect rom the order dated 07.07.1998, however, respondents while computing the retiral dues has not taken into consideration, the revised pay-scale of the petitioner against which, petitioner had submitted 3 representation dated 18.02.2025 and 24.09.2025 (Annexure P/5) before the Respondent No. 5 which is pending consideration and therefore, direction be issued to the Respondent No. 5 to consider and take decision on the representation within specified time frame. 4. 4. On the other hand, learned counsel for the Respondents/State would submit that as petitioner is not pressing this writ petition on merits and is only seeking a direction to the Respondent No. 5 to consider and take decision on the representation, she is having no objection to the limited prayer. 5. I have heard learned counsel for the parties and perused the documents placed on record. 6. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without entering into merits of the claim of petitioner, this writ petition at this stage is disposed of directing the Respondent No. 5 to consider and take decision on the representations dated 18.02.2025 and 24.09.2025 submitted by the petitioner on its own merits in accordance with law, expeditiously, preferably within a period of 03 months from the date of receipt of order. 7.
