1. Through this Writ Petition filed under Article 226 of the Constitution of India, the Petitioner inter-alia, prays for direction to the Respondent for unconditional release of gold bar weighing 100gram which was detained on 12.10.2024.
2. In substance, the Petitioner claims that no Show Cause Notice within the prescribed time has been issued to him, hence, the proceedings have lapsed whereas, the Respondent claims that the Petitioner while submitting statement under Section 108 of Customs Act has waived the Show Cause Notice. It has also been submitted that the Petitioner was sent Notice on 13.05.2026 for personal hearing, however, the Petitioner did not respond. This is a digitally signed order.
