P.P. ------- Order No.02/Dated- 09.01.2026 1. Heard Mr. Hadish Ansari, learned counsel for the appellant and learned Spl. P.P. 2. This appeal is directed against the order dated 15.12.2025 passed by learned Sessions Judge, Latehar in A.B.P. No.516 of 2025 arising out of AHTU P.S. Case No.01 of 2024, whereby and whereunder the prayer for bail of the appellant has been rejected. 3. It has been alleged that the accused persons including the present appellant had induced the daughter of the informant and taken away to New Delhi where she was sold. After much search, the daughter of the informant was traced out in the house of Pappu Yadav, who had demanded an amount of Rs.11,000/- to return back his daughter. 4. Submission has been advanced by learned counsel for the appellant that there is no specific allegation against the appellant. It has further been submitted that the victim has been recovered from Sonipat, Haryana where she was employed as a domestic help by an agency run by Pappu Yadav. Learned counsel further submits that the only incriminating material against the appellant appears to be the confessional statement of the appellant as well as co-accused persons. 2026:JHHC:427-DB 5. Learned Spl. P.P. has opposed the prayer for bail of the appellant. 6. On consideration of the fact that the victim has been recovered and that she was employed through a placement agency run by Pappu Yadav as a domestic help in Sonipat, Haryana and the fact that the allegations against the appellant appears to be vague and general in nature, we while setting aside the order dated 15.12.2025 passed by learned Sessions Judge, Latehar in A.B.P. No.516 of 2025 arising out of AHTU P.S. Case No.01 of 2024, direct the appellant to surrender before the learned Trial Court within a period of four weeks and on his surrender, the learned Court below shall release him on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of Learned Chief Judicial Magistrate, Latehar in connection with AHTU P.S. Case No.01 of 2024. 7. Accordingly, this appeal is allowed. (Rongon Mukhopadhyay, J.) (Pradeep Kumar Srivastava, J.) Dated: 9th January, 2026 Sachin/
