The instant writ application has been preferred by the petitioner praying therein for the following reliefs: i. For a writ of mandamus, declaring the action of the respondent Jharkhand Staff Selection Commission in not calling the Petitioner for document verification in the subject of History, despite the Petitioner having secured exceptionally high normalized marks i.e. 97%, and having been declared qualified in the Post Graduate Trained Teacher Competitive Examination-2023, as illegal, arbitrary, unreasonable, discriminatory and violative of Articles 14 and 16 of the Constitution of India. ii. For a of mandamus commanding upon the respondent Jharkhand Staff Selection Commission to forthwith publish the complete and transparent subject-wise as well as category-wise merit list, including disclosure of cut-off marks by the last selected candidate in the subject of History, for the post of Post Graduate Trained Teacher pursuant to Advertisement No. 02/2023 2026:JHHC:18018 2 (Annexure 1), in the interest of fairness, transparency and accountability in public recruitment. iii. For a writ of mandamus commanding the respondent Jharkhand Staff Selection Commission to consider the candidature of the Petitioner in accordance with his merit position, to call them for document verification, and upon due verification, to grant appointment to the post of Post Graduate Trained Teacher in their respective subjects strictly in accordance with law. 3. The grievance of the petitioner is that though he appeared in the examination held by JSSC pursuant to the Advertisement No.02/2023 and he secured 293.24100 out of 300, but he has not been selected, though his juniors have been selected; however, learned counsel fairly submits that the petitioner may be given liberty to approach the Controller of Examination, so that the said respondent shall verify the records of the case and pass an appropriate order and if the petitioner is having more marks than the other candidates, then necessary order be passed. 4. Learned counsel for the respondent-JSSC does not object the contention for approaching the Controller of Examination. 5. Having regard to the above, the instant writ applications is disposed of by directing the petitioner to file a detailed representation annexing all the relevant documents before the respondent No.6-Controller of Examination, JSSC, who upon receipt of the same shall look into the grievance of the petitioner and take a decision in the matter in accordance with law and applicable rules and regulations by passing a reasoned and speaking order within a period of 8 weeks from the date of receipt of such representation and communicate the same to the petitioner. 6.
