NATARAJ ORAL ORDER The petitioner has challenged the proceedings launched against him by the respondent No.1 in C.C.No.21290/2026 pending on the file of the I Additional Chief Metropolitan Magistrate, Bengaluru for the offence punishable under Section 109(1) of BNS. 2. The respondent No.2 is served and represented by a counsel. 3. The learned counsel for the petitioner and the learned counsel for the respondent No.2 submit that the petitioner and the respondent No.2 have amicably settled the dispute and have filed a joint memo, which reads as follows:- - 3 - HC-KAR NC: 2026:KHC:25297 CRL.P No. 7407 of 2026 "JOINT MEMO FILED BY THE PETITIONER AND RESPONDENT NO.2 The Petitioner/Sole Accused and Respondent No.2 respectfully submit as under: 1. The Petitioner has filed the present petition seeking quashing of the proceedings in C.C.No.21290/2026 arising out of Crime No.275/2025 registered for the offence punishable under Section 109(1) of the Bharatiya Nyaya Sanhita, pending on the file of the I ACMM, Nrupatunga Road, Bengaluru. 2. Respondent No.2 is the defacto complainant in the above case. The complaint relates to an incident alleged to have taken place on 26.10.2025 near M.S. Ramaiah Hospital Bus Stop, Bengaluru, wherein it was alleged that the vehicle driven by the Petitioner dashed against the scooter of Respondent No.2 and her family members, resulting in simple injuries. 3. During the pendency of the present proceedings, elders and well-wishers from both sides intervened and held discussions, pursuant to which the matter has been amicably settled between the Petitioner and Respondent No.2. - 4 - HC-KAR NC: 2026:KHC:25297 CRL.P No. 7407 of 2026 4. Respondent No.2 states that the incident occurred due to misunderstanding during the course of traffic movement on the road and that she does not intend to proceed with the matter any further against the Petitioner. 5. Respondent No.2 has no objection for quashing of the proceedings in C.C.No.21290/2026 arising out of Crime No. 275/2025 insofar as the Petitioner is concerned. 6. The settlement has been arrived at voluntarily and without any force, pressure or coercion from any person. The parties submit that continuation of the criminal proceedings would serve no useful purpose and the same may be brought to an end in the interest of justice. WHEREFORE, the Petitioner and Respondent No.2 jointly pray that this Hon'ble Court may be pleased to record this Joint Memo and quash the proceedings in C.C.No.21290/2026 arising out of Crime No.275/2025 pending on the file of the I ACMM, Nrupatunga Road, Bengaluru, in the interest of justice and equity." 4. The petitioner and the respondent No. 2 are present and are identified by their respective counsel and they have signed the order sheet of this Court in token of their acceptance of the terms of joint memo. 6. Accordingly, this petition is allowed. Further proceedings launched against the petitioner by the respondent No.1 in C.C.No.21290/2026 pending on the file of the I Additional Chief Metropolitan Magistrate, Bengaluru for the offence punishable under Section 109(1) of BNS stands quashed. 7.
