The petitioner has filed this writ petition seeking following reliefs:- “10.1 That the Hon'ble Court may kindly be pleased to direct the respondents to issue a fresh promotion order in the favour of the petitioner on the post of Joint Director (Agriculture) with effect from 2006 in consonance to the review DPC conducted on 08.10.2021 (Annexure P/5) 10.2 That the Hon'ble Court may kindly be pleased to direct the respondents to consider the candidature of the petitioner to the post of Additional Director (Agriculture) in accordance with the Rules governing the service conditions of the petitioner and 2 also in consonance to the review DPC conducted on 08.10.2021 (Annexure P/5). 10.3 Any other relief, which this Hon'ble Court may deem fit and proper in the present circumstances of the case.” 2. Learned counsel for the petitioner submits that the claim of petitioner was considered in review DPC held on 08.10.2021 with reference to the DPC conducted on 15.12.2006. He contended that after convening of the meeting of the DPC in the year 2006, first review DPC was held on 21.06.2021 and thereafter, again a review DPC with reference to DPC of the year 2006 was held on 08.12.2021. In the last DPC, name of the petitioner was recommended for his promotion on the post of Joint Director from the date when he became eligible, however, till date, the order of promotion has not been issued, aggrieved with which, petitioner has submitted multiple representations and lastly on 08.01.2025 which was received by the authority on 10.01.2025 and therefore, direction be issued to the Respondent No. 1 to consider and take decision on the pending representation at the earliest within specified time frame. 3. On the other hand, learned counsel for the Respondents/State would submit that as petitioner is not pressing this writ petition on merits and is only seeking a direction to the Respondent No. 1 to consider and take decision on the representation, she is having no objection to the limited prayer. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without entering into the merits of the claim of petitioner, this writ petition at this stage is disposed of directing the Respondent No. 1 to consider and take decision on the representation dated 08.01.2025 3 submitted by the petitioner in accordance with law, expeditiously, preferably within a period of 02 months from the date of receipt of representation. Howeveer, petitioner will also be at liberty to submit fresh representation, if he so desires. 6. With the aforesaid observation and direction, this writ petition stands disposed of.
