JUSTICE PRAVEER BHATNAGAR Order 12/01/2026 1. Apprehending his arrest in connection with FIR No. 465/2024 registered at Police Station Jurhara, District Deeg for the offences under Sections 189(2), 115(2), 126(2), 333 and 303(2) of BNS, the accused-petitioner has preferred this anticipatory bail application under Section 482 BNSS. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the co-accused Naresh and Ramniwas have already been enlarged on bail by the concerned Court and custodial interrogation against the accused-petitioner is no required. The allegation against the petitioner along with the other co-accused of causing assault upon the complainant is omnibus in nature. The police did not find commission of offence under Section 302(2) of BNS. The petitioner is a lady, therefore, the anticipatory bail application of the accused-petitioner may be allowed. [2026:RJ-JP:1165] (2 of 2) [CRLMB-9015/2025] 3. Learned Public Prosecutor has vehemently opposed the anticipatory bail application and contended that the petitioner along with the other co-accused assaulted the complainant resulting in several injuries, therefore, the anticipatory bail application of the accused-petitioner is hereby dismissed. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the petitioner and after going through the nature of injuries caused to the injured, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioner on bail. 6. Accordingly, the anticipatory bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Saroj W/o Naresh, in connection with FIR No. 465/2024 registered at Police Station Jurhara, District Deeg, shall be enlarged on bail provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without previous permission of the court.
