( 2026:JHHC:19001 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI
B.A. No. 5962 of 2026
------ Farhan Akhtar @ Farhan Ahmad, aged about 32 years, son of Praviz Iqbal @ Pervez Eqbal, resident of New Mohalla, Village-Shahpur, P.O.-Shahpur, P.S.-Daltonganj Town, Dist.- Palamau
… Petitioner
Versus The State of Jharkhand … Opposite Party
------
CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY
------
For the Petitioner : Mr. A.K. Chaturvedy, Advocate
: Mr. Imtiaz Khan, Advocate For the State
: Mr. Ajay Kr. Pathak, Addl. P.P. ------
Order No.02 Dated- 30.06.2026
Heard the parties.
The petitioner has moved this Court for grant of bail in connection with Daltonganj Town P.S. Case No.335 of 2025 registered for the offences punishable under sections 336(2)/338/ 336(3)/336(4)/339/340(2)/318(4)/319(2)/3(5) of the B.N.S., 2023.
The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed forgery and 11 forged birth certificates having fake logo, Bar Code and Q.R. Code was recovered from the shop of the petitioner. It is further submitted that the allegations against the petitioner are all false and the investigation of the case is going on. It is then submitted that the co-accused-father of the petitioner to whom the shop belongs have been admitted to bail. It is then submitted that the petitioner has been in custody since 02.05.2026, as has been mentioned in paragraph no. 16 of the bail application. Hence, it is submitted that the petitioner be admitted to bail.
The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail of the petitioner and submits that there is direct allegation against the petitioner of committing forgery by creating forged birth certificates on the basis of fake logo, Bar Code and Q.R. Code. It is next submitted by learned Addl. P.P. that since
there was no allegation of commission of forgery against the co- accused-father of the petitioner who has been granted bail therefore, the allegation against the petitioner stands in a different and more graver footing then that of his father. It is next submitted that there is every chance of the petitioner absconding and tampering with evidence, if released on bail. It is lastly submitted that the petitioner ought not to be admitted to bail.
Considering the serious nature of allegation against the petitioner of committing forgery and creating forged birth certificates on the basis of fake logo, Bar Code and Q.R. Code as well as the chance of the petitioner absconding and tampering with evidence, if released on bail, this Court is of the considered view that this is not a fit case where the abovenamed petitioner be admitted to bail. Accordingly, the prayer for bail of the abovenamed petitioner is rejected.
