It is submitted that the allegation against the petitioner is false. It is next submitted that though the co-accused Rahul Singh, Dablu Singh and Sanjay Pal were seen running towards the Basti but the petitioner has been implicated in this case only on the basis of suspicion that he being the friend of Rahul Singh, he might have committed the murder of Shekhar Sandil because of the enmity between the deceased and Rahul Singh. It is further submitted that though charge has already been framed in this case but no witness has been examined as yet. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
