Petitioners have filed the present petition, under Article 227 of the Constitution of India, against the order dated 13.11.2025, passed by the learned Civil Judge (Jr. Division), Court No. 4, Shimla, H.P. (hereinafter referred to as ‘the trial Court’), in Civil Suit No. 900723 of 2017, titled as, ‘Bhawani Dutt Sharma and others versus State of H.P. & others’.
2. Vide order dated 13.11.2025, the evidence of the defendant has been ordered to be closed.

3. With the consent of learned counsel for respondent, the present petition is allowed by granting one more opportunity to the petitioners, who are defendants, before the learned trial Court, to adduce evidence, by producing the same, on self-responsibility.
4. In view of above, order dated 13.11.2025, passed by the learned trial Court is set aside and the petitioners/defendants are permitted to lead their evidence, on self responsibility.
5. Parties to the lis are directed to appear before the learned trial Court, on 10.8.2026. On the said date, the learned trial Court will fix the date for DWs. It is made clear that no further opportunity shall be given to the defendants to adduce evidence.
6. In view of above, the present petition is dispoed of. The pending application(s), if any, are also disposed of. (Virender Singh) 31.7.2026 Judge Kalpana
