Mahato, AC to AG …...... 02/ 29.06.2026: Heard, learned counsel for the petitioner and learned counsel for the State. The order under Public Land Encroachment Act is under challenge. 2. In this writ petition, the petitioner has prayed for the following reliefs:- “a. For Issuance of appropriate writ/order/direction particularly in the nature of Certiorari for quashing the order dated 29.12.2023 passed in J.P.L.E. Case No. 32/2019-20 by the learned Collector-cum-Divisional Forest Officer, Jamshedpur Forest Division, Jamshedpur (Annexure-1) whereby and whereunder J.P.L.E. Case No. 32/2019-20 initiated at the instance of Government of Jharkhand has been allowed; And b. For Issuance of appropriate writ/order/direction particularly in the nature of Certiorari for quashing the order dated 14.02.2026 passed by the learned Deputy Commissioner-cum-District Magistrate, East Singhbhum, Jamshedpur in J.P.L.E. Appeal No. 52/2024-25 (Annexure-3) whereby and whereunder J.P.L.E. Appeal No. 52/2024-25 filed by the petitioner has been dismissed.” 3. Learned counsel for the petitioner categorically made a statement that the land which is the subject matter of the proceeding, is not in occupation of the petitioner and he has no concern with the same. 4. In view of the categorically submission given by the learned counsel for the petitioner, the petitioner cannot be said to be an aggrieved party just because of the fact that the notice has been issued in the name of the petitioner. Even if the notice has been issued to the petitioner, since the petitioner says that he is not occupying the said land in question which is the subject matter in the proceeding and he has no concern with the same, I am not inclined to interfere with the impugned order, this writ petition is thus dismissed.
