JUSTICE RAVI V HOSMANI - 3 - HC-KAR NC: 2026:KHC:25515 WP No. 13734 of 2020 ORAL ORDER Challenging FIR in Crime no.192/2020 registered by Sarjapur Police Station, Bengaluru for offences punishable under Sections 143, 420, 504, 506 and 149 of IPC, this writ petition is filed. 2. Sri PP Hegde, learned Senior Advocate appearing for Sri Venkatesh Somareddi, learned counsel for petitioners filed a memo producing copy of order passed by Commercial Court, Bangalore, in Com.AP. no.121/2022 disposed on 18.07.2024 by accepting compromise petition between contesting parties herein and submitted that one of terms of compromise was that respondent no.2-complainant would withdraw allegations made against petitioners herein in above mentioned complaint in Crime no.192/2020. In view of compromise, continuation of proceedings would be futile if not abuse of process of Court and prayed for allowing petition. 3. Learned counsel for respondent no.2 affirms settlement and submits no objections for memo. - 4 - HC-KAR NC: 2026:KHC:25515 WP No. 13734 of 2020 4. Learned HCGP appearing for respondent no.1-State would graciously submit no objection for disposal of petition in view of settlement. 5. This writ petition was filed challenging registration of Crime no.192/2020 ('complaint'). Averments in it as well as in this petition would indicate that there was a civil dispute between parties leading to filing of commercial dispute as well as filing of complaint. As per order produced along with memo filed today, during pendency of this petition staying complaint, parties reported compromise before Commercial Court. Compromise contains undertaking by respondent no.2- complainant to withdraw allegations made in complaint. 6. It is also seen that compromise between parties is at inception stage and dispute is purely inter se and does not have any societal bearings nor offences alleged are for heinous crimes. Continuation of proceedings would be abuse of process instead of securing ends of justice to parties. There would be no impediment to allow petition as per ratio laid down in Gian Singh v.
