HON'BLE THE ACTING CHIEF JUSTICE MR. SANJEEV PRAKASH SHARMA
Order 31/01/2026
1. Heard on application (No.156/2022) for condonation of delay in filing the review petition.
2. For the reasons mentioned in the application, the same is allowed. Delay in filing the review petition is condoned.
3. This is a review petition seeking review of the order dated 05.03.2021 passed by this Court, whereby this Court covered the cases by the judgment passed by the Hon’ble Supreme Court in the case of Prakash Chand Meena and Others Vs. State of Rajasthan and Others, reported in (2015) 8 SCC 484.
4. It appears that the review-petitioner filed SLP before the Hon’ble Supreme Court, however, later on, withdrew the same with liberty to file a review petition before this Court, leave for which was granted by the Hon’ble Supreme Court.
5. Having condoned the delay, I have carefully re-examine the issue raised by the review-petitioner in this review petition. This Court finds that, from the facts which have come on record, it is apparent that the review-petitioner too, does not fall within the ambit of eligibility. Although, the review-petitioner belongs to SC/ST category, but the review-petitioner possessed qualification of B.P.Ed., while the notification for the post of PTI Grade-III has
[2026:RJ-JP:4557] (3 of 3) [WRW-154/2022] been held to be only C.P.Ed. by the Hon’ble Supreme Court in the case of Prakash Chand Meena (supra).
6. Considering the law laid down by the Hon’ble Supreme Court in the case of Prakash Chand Meena (supra), the contention of
learned counsel for the review-petitioner that he may be allowed to be appointed against the post which remain vacant, cannot be accepted, as the minimum eligibility is the first aspect, which is required to be considered for appointment.
7. Accordingly, the review petition is dismissed.
