Order on Board 23/03/
2026
1. This petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is preferred by the petitioner challenging the order dated 12.01.2026 passed by the 4th Additional Sessions Judge, Raipur (C.G.), in Criminal Revision Case No. 09/2026, whereby the revision petition has been dismissed, affirming the order dated 06.12.2025 passed by the Chief Judicial Magistrate, Raipur (C.G.), in Criminal Case No. 14998/2025, wherein the application filed by the petitioner to de-freeze the bank accounts which had been frozen by Police SOURABH PATEL Digitally signed by SOURABH PATEL Date: 2026.03.24 10:23:32 +0530
2 Station Civil Lines, Raipur, in connection with Crime No. 54/2025 for offences punishable under Sections 420, 467, 468, 471, and 34 of the IPC, has been rejected.
2. The facts of the present case are that Police Station Civil Lines, Raipur (C.G.), had filed a charge-sheet against the petitioner along with other co-accused for offences under Sections 420, 467, 468, 471, and 34 of the IPC in connection with Crime No. 54/2025. During the investigation, three bank accounts of the petitioner were frozen, wherein the prosecution alleges that the amount obtained by cheating has been deposited.
3.
Learned counsel for the Petitioner submits that the orders passed by the learned trial Court and the revisional Court are bad in law. He further submits that the petitioner is a government employee and his salary is being credited into one of his frozen bank accounts. Due to the freezing of his three bank accounts, he is unable to carry out any financial transactions and is facing a financial crisis. Hence, the present revision petition is liable to be allowed and the frozen accounts of the petitioner be defrozen.
4. I have heard learned Counsel appearing for the Petitioner and perused the documents annexed with the petition including the
order sheets of the Trial Court.
5. On being asked about the government service in which the petitioner is employed, the counsel for the petitioner was unable to inform the same. He also does not have information on how many bank accounts the petitioner has.
6. Considering the overall material on record and also taking into
3 account that the petitioner, along with his associates, has allegedly swindled money from several people in the name of providing employment, I do not find any infirmity or irregularity in the impugned order passed by the learned trial Court, as affirmed by the learned Revisional Court, warranting interference by this Court.
7. Accordingly, the instant petition is hereby dismissed at motion stage itself. Sd/- (Sanjay Kumar Jaiswal) Judge Sourabh P.
