k 1/2 56 wp 7552.26 as.doc IN THE HIGH COURT OF JUDICATURE AT BOMBAY CIVIL APPELLATE JURISDICTION WRIT PETITION NO.7552 OF 2026 Dhnanjay Sureshrao Dabhade & Anr. ....Petitioners V/S The Divisional Joint Registrar Co-operative Societies & Ors. ....Respondents _________ Mr. Amol A. Gatne for the Petitioners. Mr. Pankaj Das for Respondent Nos.5, 7, 9 and 10. Ms. S.D. Chipade, AGP for Respondent Nos.1 and 2/State. Mr. Sumatilal F. Kataria through it POA Mr. Rajkumar Kataria for Respondent No.4. __________ CORAM : SANDEEP V. MARNE, J. DATE : 12 OCTOBER 2026. P.C.: 1. The Petition challenges order dated 10 June 2026 passed by the Divisional Joint Registrar, Co-operative Societies, Pune Division, Pune, rejecting the stay application filed in Revision Application No.168 of 2026. 2. While issuing notice, this Court has passed following order on 17 June 2026: “1) Limited grievance raised in the present Petition is about non-grant of stay by the Revisional Authority during pendency of the Revision against order dated 12 May 2026 passed by the Deputy Registrar of Co-operative Societies. By order dated 12 May 2026, the Deputy Registrar has issued a declaration that Petitioners have ceased to be the members of the Managing Committee and are disqualified for being elected as members of the Managing Committee for a period of five years. The Revision is still pending before the Divisional Joint katkam Page No. 1 of 2 2026:BHC-AS:41515 k 2/2 56 wp 7552.26 as.doc Registrar. However, Petitioners’ prayer for stay of order of the Deputy Registrar is rejected by the Divisional Joint Registrar by order dated 10 June 2026, which is subject matter of challenge in the present Petition. 2) Issue notice to Respondent No.4, at whose instance the order dated 12 May 2026 is passed by the Deputy Registrar, indicating the returnable date as 7 July 2026. Hamdast is granted. In addition to court notice, Petitioners to serve Respondent No.4 by private service and file affidavit of service. 3) Till the next date of hearing, order dated 12 May 2026 passed by the Deputy Registrar shall remain stayed. “ 3. Thus during pendency of the Petition disqualification order dated 12 May 2026 passed by the Deputy Registrar has been stayed. In my view therefore, instead of determining correctness of the order dated 10 June 2026 passed by the Divisional Joint Registrar it would be appropriate that he decides the pending Revision Application in an expeditious manner. 4. Accordingly, it is directed that the Divisional Joint Registrar shall decide Revision Application No.168 of 2026 as expeditiously as possible preferably within six weeks. It is reported that the next date in the Revision Application is 21 October 2026. If that is the case, Petitioners undertake to argue the pending Revision Application before Divisional Joint Registrar. This Court has not expressed any opinion on the merits of the matter and all contentions of the parties on merits are expressly kept open. Till the Divisional Joint Registrar decides the Revision Application, the order dated 10 June 2026 passed by the Divisional Joint Registrar shall remain stayed. Writ Petition is accordingly disposed of. (SANDEEP V. MARNE, J.) katkam Page No. 2 of 2 Signed by: Sudarshan R. Katkam Designation: PS To Honourable Judge Date: 13/10/2026 15:52:58
