According to the petitioner, in a combined selection for various Group-C posts, held by Uttarakhand Subordinate Service Selection Commission, he is after the last selected candidate in the merit list in open category. 3. According to him, there are certain vacancies reserved for Uttarakhand Andolankari, which could not be filled due to non availability of candidates, therefore, he has a right to be recommended against such unfilled vacancies. 4. Mr. Shailendra Nauriyal, learned counsel appearing for the Selecting Body, however, submits that guidance from State Government is sought on certain aspects regarding candidates belonging to Uttarakhand Andolankaries, who have participated in the selection, but their names could not be recommended for appointment owing to certain reasons, therefore, till the time instructions from State Government are received, no decision can be taken for 2026:UHC:2406 recommending the name of petitioner and other candidates against such unfilled vacancies. 5. Since the matter is pending consideration before the State Government, therefore, the writ petition is disposed of with liberty to petitioner to make representation to the Secretary, Personnel and Appointment. 6. If he makes representation within one week from today, decision thereupon shall be taken, as per law, within four weeks thereafter.
