The petitioner is apprehending her arrest in connection with Barhi P.S. Case No. 197 of 2025, registered for the offence under Sections 80(2), 61(2) and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Sub Divisional Judicial Magistrate, Hazaribagh. 3. Learned counsel appearing for the petitioner submits that the petitioner is the widow sister-in-law of the deceased. He further submits that allegation of assault is there against the husband namely Satyendra Jaiswal. He next submits that entire family members have been made accused however, the allegation of assault is there against husband. He also submits that cause of death is said to be shock and hemorrhage. On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposes the prayer and submits that the petitioner happens to be the widow sister-in-law of the deceased and the allegations are there against the petitioner and the other family members of helping the husband and making assault. He further submits that in para 41 of the case diary, it has been stated by the daughter of the deceased that the petitioner and other family members used to assault the deceased. On these grounds, he submits that anticipatory bail may kindly be rejected. 5. In the FIR, there is direct allegation of torture, demand of dowry and abortion against the husband namely Satyendra Jaiswal and it is alleged in the FIR that petitioner along with other family members have 2026:JHHC:18971 helped the husband in killing the deceased, prima facie it appears that so far this petitioner and other family members are concerned, allegation is general and omnibus and the petitioner is said to be widow sister-in-law of the deceased and in para 41 of the case diary, it has also come that all the family members used to torture and that is also general and omnibus, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned court within two weeks from today and in the event of her arrest or surrender, she shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Hazaribagh, in connection with Barhi P.S.
