The petitioner is apprehending his arrest in connection with Dhanbad PS Case No.373 of 2024, for offence registered under section 190, 191, 115, 126, 109, 140(1), 308, 352, 353 of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Dhanbad. 3. Learned counsel for petitioner submits that false allegations are made against the petitioner and the petitioner is not named in the FIR and only on confessional statement the name of the petitioner has come. He also submits that the petitioner is a labourer and on fateful day, he was travelling from Kolkata to Bangaluru along with his wife. He also submits that the other persons against whom the charge sheet has been submitted, they have faced the trial and have been acquitted by the learned District and Sessions Judge, Dhanbad vide judgment dated 21.4.2026 in 2026:JHHC:18826 2 S.T. Case No.87 of 2025. 4. Learned State counsel opposes prayer and submits that name of the petitioner has come on confessional statement. 5. Considering that the name of the petitioner has come on confessional statement and the petitioner is not named in the FIR and further the persons against whom the charge sheet has been submitted, they have been acquitted by the learned Sessions Judge, Dhanbad in S.T. Case No.87 of 2025 and further it has been pointed out that the petitioner is a labourer, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Dhanbad, in connection with Dhanbad PS Case No.373 of 2024, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
