This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.170/2025 registered at Police Station – Gidhauri, Distt-Balodabazar-Bhatapara (C.G.) for the offence punishable under Sections 318(4), 111, 3(5) of B.N.S, 2023. Case of the prosecution, in brief, is that a written complaint was lodged on 24.07.2025 by the complainant (Deepak Kumar Dansena), alleging that the main accused persons (Ramnarayan Sahu & Atmaram Sahu) and their associates lured the complainant by promising extraordinary returns (doubling or tripling the investment within a year) through the stock market. The complainant, allegedly invested a total sum of Rs.1,58,45,000/- into the scheme. The present applicant was not named in the FIR but was made an accused only on the basis of the memorandum of the main accused. On the basis of which a crime was registered against the main accused (Ramnarayan Sahu and others) by the P.S. Gidhauri, Crime No. 170/2025 u/s 318(4), 111, 3(5) of B.N.S, 2023. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He would submit that the implication of the applicant is based solely on memorandum statements of co-accused (Ramnarayan Sahu and Atmaram Sahu). He would submit that the applicant is neither named in the FIR nor in the statement under Section 180 of the complainant. He would submit that co-accused namely Sampat Kumar Sahu has been granted anticipatory bail by this Court vide order dated 27.02.2026 in MCRCA No. 226/2026 and also co-accused Tulsinand Sahu has been granted anticipatory bail by this Court vide order dated 18.03.2026 in MCRCA No. 415 of 2026. He would further submit that applicant is ready to abide by all the directions and conditions, which may be imposed by this Court while granting bail and the applicant is a permanent resident of address mentioned in the cause title, therefore, there is no likelihood 3 of his absconding, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail but do not dispute the fact that co-accused persons have been granted anticipatory bail by this Court. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the fact that co-accused namely Sampat Kumar Sahu has been granted anticipatory bail by this Court vide order dated 27.02.2026 in MCRCA No. 226/2026 and also co-accused Tulsinand Sahu has been granted anticipatory bail by this Court vide order dated 18.03.2026 in MCRCA No. 415 of 2026 and also considering the fact that investigation and trial are likely to take some time, without commenting anything on the merits of the case, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Rajkumar Sahu, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to 4 dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
