This intra court Appeal seeks to challenge the order dated 03.09.2026 (“Impugned Order”) passed by learned Single Judge in W.P.(C) No. 12341/2026 (“Writ Petition”) instituted by the Appellant against an order dated 04.08.2026 passed by the Respondent-Bank, whereby the bank account of the Company, in which the Appellant is erstwhile Non-Executive Director, has been declared to be a fraud. Vide the Impugned Order, learned Single Judge has only issued notice and granted opportunity to the Respondent-Bank to file the reply to the Writ Petition. Thereafter, the matter has been listed on 25.02.2027. 6. Since, no issue, not even a prayer for grant of interim relief has been either considered or decided by learned Single Judge while passing the Impugned Order, this intra court Appeal is not maintainable, which is hereby dismissed. 7. However, having regard to the submissions made by learned Counsel for the Parties, we provide that reply / objection to CM APPL. 57253/2026 in the Writ Petition pending before learned Single Judge shall be filed by the Respondent-Bank within a period of one week from today. Response to the reply / objection shall be filed by the Appellant within a period of one week thereafter. 8. We further permit the Appellant to move an appropriate application for preponing the date of hearing of CM APPL. 57253/2026 for grant of interim relief and request the learned Single Judge that, in case any such application is moved by the Appellant, the same shall be considered and decided expeditiously.
