Learned advocate appearing for the petitioners submits that after 25 years of marriage, the petitioner no.1 and all his family members have been implicated in connection with the instant case. According to the petitioners, the accusations made against them are without any factual foundation and as such, they may be granted the privilege of anticipatory bail. Learned advocate appearing for the State produces the case diary and draws the attention of the Court to the statement of the victim as well as the statement of the neighbours. 2 I have taken into account the injury report and the statement of the victim and having considered the same, I am of the view that the prayer for anticipatory bail of the petitioner no.1 viz. Sagram Hemram @ Shegram Hemram @ Hembram is rejected. However, so far as the prayer for anticipatory bail of the petitioner Nos. 2, 3, 4 and 5 are concerned, I am of the opinion that their custodial interrogation is unwarranted. As such, the prayer for anticipatory bail of the petitioner Nos. 2, 3, 4 and 5 is allowed. Accordingly, in the event of arrest, the petitioners viz., 2. Ramesh Hemram @ Hembram, 3. Dunui Hemram @ Hembram, 4. Chunu Hemram @ Hembram and 5. Basanti Hemram shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The application for anticipatory bail, being CRM (A) 8 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
