This MCC has been filed for modification/recall of order dated 27/02/2026 passed in WPC No.852/2026 (Loknath Patel Vs. State of CG and Ors). 2. Learned counsel for the petitioner submits that in the aforesaid writ petition on 27.02.2026 though writ petition was dismissed as withdrawn with liberty to file appropriate appeal before the Revenue Authority, however, counsel appearing for the petitioner therein inadvertently contended for withdrawal of writ petition. Therefore, 'prayer of withdrawal' be removed from the order dated 27.02.2026 and said order be modified accordingly. 3. Learned State counsel submits that the earlier writ petition was dismissed as withdrawn on the prayer made by counsel for the petitioner therein. Moreover, liberty was duly granted to file an appeal under Section 44 of the Chhattisgarh Land Revenue Code, 1959, therefore, there is no necessity to recall of the earlier order. 4. Having considered the aforesaid submissions, and considering the fact that petitioner while passing the order dated 27.02.2026 himself prayed for withdrawal and that liberty was also granted to the petitioner to file an appeal under Section 44 of the Chhattisgarh Land Revenue Code, 1959, this Court does not find any cogent reason to entertain the instant MCC. 5.
