Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs :- 2 “10.1 That this Hon’ble Court may kindly be pleased to respondent authority to disburse the compensation amount to petitioner for land bearing khasra No. 40/1 admeasuring 0.101 hectare. 10.2 That this Hon’ble Court may kindly be pleased to direct the respondent authority to also provide interest of 12% of per annum on the compensation amount. 10.3 To kindly grant any other writ writs, orderorders, relief / reliefs in favour of the petitioner, which the hon’ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioner. 2. Learned counsel appearing for the petitioner submits that award has already passed in favour of petitioner and amount of compensation has also been calculated, despite that the same has not been disbursed to the petitioner. He further submits that the petitioner has filed application (page No. 21) before respondent No. 4, to which the respondent No. 4 has directed the petitioner to approach civil Court. He further submits that there is no dispute with regard to disbursement of amount of compensation, despite that respondent No. 4 has issued order (Annexure P-5) directing petitioner to approach before the civil Court. Hence, learned counsel for the petitioner submits that this petition may be disposed of directing respondent No. 4 to decide the application for disbursement of amount of compensation filed by the petitioner. 3. Respondent No. 3 - Collector, Raigarh and Respondent No. 4 SDO (R), Gharghoda, Tahsil Gharghoda, District Raigarh, are also present in person before this Court through Video Conferencing. They submit that appropriate steps shall be taken with regard to disbursement of amount of compensation to the petitioner. 3 4. Having considered the limited prayer made by counsel for the petitioner, without entering into the merits of the case, this petition stands disposed of directing respondent No. 4 to disburse the amount of compensation to the petitioner, if there would not be any legal impediment. 5. With the aforesaid observations & directions, the writ petition stands disposed of.
