This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 41/2025 registered at Police Station – Sukma, District Sukma (C.G.), for the offence punishable under Section 20(B)(ii)(c) of the Narcotics Drugs and Psychotropic Substances Act. 2. As per the prosecution story, in brief, the concerned Police Station Sukma received secret information from an informant alleging that the applicant was involved in selling contraband ganja weighing 24 kg and 600 grams. The police seized the said contraband ganja from the ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.03.24 18:29:50 +0530 2 possession of other accused persons. Consequently, the police registered an offence punishable under Sections 20(b)(ii)(C) of the NDPS Act against the other accused persons. The applicant has been arrested on 11.06.2025 on the basis of a memorandum statement. 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case and the alleged contraband article i.e. 24.600 Kgs of was not seized from the possession of the present applicant. He also submits that the present applicant has no criminal antecedents and he is in jail since 11.06.2025, and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 4. On the other hand, learned State counsel opposes the bail application and submits that, in the present matter, the charge-sheet has already been filed before the competent Court. She further submits the allegations against the applicant are grave and relate to the offence under Section 20(b)(ii)(C) of the NDPS Act involving a commercial quantity of contraband. It is further submitted that the applicant’s involvement has surfaced from the memorandum statement. She also submits that the bail application of a co-accused person, namely, Nitin Raghav, has already been rejected by this Court vide order dated 31.10.2025 passed in MCRC No. 8642 of 2025, and therefore, the present bail application also deserves to be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the submissions made by the parties and on perusal of the case diary, this Court finds that the allegations against the applicant are grave in nature, involving commercial quantity of contraband under the 3 NDPS Act. The involvement of the applicant has surfaced from the memorandum statement of the other co-accused person, further, the bail application of co-accused Nitin Raghav has already been rejected by this Court on similar grounds, therefore, the bail application of the present applicant is also entitled to be rejected. 7. Accordingly, the bail application of the applicant – Vijay Biswas, filed under Section 483 of the BNSS, involved in Crime No. 41/2025 registered at Police Station – Sukma, District Sukma (C.G.), for the offence punishable under Section 20(B)(ii)(c) of the Narcotics Drugs and Psychotropic Substances Act, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
