1. Petitioner has filed this writ petition seeking following reliefs:-
“10.1 That this Hon’ble Court may kindly be pleased to call for the records of the petitioner from the respondents; 10.2 That this Hon’ble Court may kindly be pleased to direct the respondents to regularize the services of the petitioner on the regular, vacant and sanction post of Medical Lab Techologist; 10.3 That, this Hon’ble Court may kindly be pleased DEEPTI JHA Digitally signed by DEEPTI JHA
2 to direct the respondents to grant all consequential benefits to the petitioners for the post of Medical Lab Technologist; 10.4 Any other order(s), direction(s) and relief(s) which this Hon’ble Court may think fit and proper in the facts and circumstances of this case, may also please be granted to the petitioner; 10.5 Cost of the petition may also be awarded to the petitioner from the respondents.”

Learned counsel for petitioner submits that initially petitioner was appointed as Medical Lab Technologist and continuously discharged his duties till 30.09.2013 and thereafter, he was terminated on the ground that he had exceeded the prescribed upper age limit for regularization of service. However, the petitioner preferred WPS No.984/2013 along with other similarly placed employees. In the said writ petition, direction was issued by this Court vide order dated 01.07.2024 that petitioners may be considered for appointment in upcoming advertisements or recruitment process or vacant posts available with the department. Petitioners were though appointed, pursuant to the order of this Court, however, the petitioner has been discriminated from one Prakash Chand Pandey, who also filed a separate WPS No.2530/2013. Prakash Chand Pandey was given regular appointment vide order dated 20.03.2025. Petitioner, therefore, has submitted representation dated 19.01.2026 (Annexure-P/4) before the respondent No.3/Chhattisgarh Institute of Medical Science (CIMS), through its Dean, Main Road Sadar Bazar, Bilaspur (C.G.). Respondent No.3 wrote a letter dated 24.02.2026 to the Commissioner, seeking direction for regularization of the employees working temporarily, mentioning that out of 45 sanctioned posts of Medical Lab Technologist, on 31 posts regular employees are working, on 12 posts contractual employees are working and 2 posts are lying vacant, but till date Commissioner, Medical Education, Raipur (C.G.)
3 has not taken any decision, therefore, a direction may be issued the Commissioner to take decision, respondent No.3 may be directed to take decision and give regular post of Lab Technologist to the petitioner. 3.

Learned State counsel submits that petitioner is not pressing this petition on merits, but only seeking direction to take decision on the letter forwarded by the Dean (CIMS) Bilaspur (C.G.) to the Commissioner, she is having no objection. 4. On due consideration of the submission of learned counsel for the respective parties, nature of grievance raised, this writ petition is disposed of directing Commissioner, Medical Education, Raipur (C.G.) to take decision on the letter forwarded by the respondent No.3, in accordance with law, expeditiously preferably within a further period of 2 months from the date of receipt of copy of order passed by this Court. Thereafter, respondent No.3 is
directed to intimate about the decision of the Commissioner to the petitioner immediately thereafter.
5. Accordingly, this petition is disposed of with aforesaid observations and directions. Certified copy as per rules Sd/-
