Reply not filed, subject to is last opportunity. Further opportunity for the purpose is not justifiable. As such, the right of the respondent to file reply, is ordered to be closed. 2. Applicant­NHAI   has   filed   the   present application for condonation of delay, which, as per the application is 140 days, whereas, as per the report of Registry,  the  same  is   95  days.     The   delay   has  been sought to be condoned on the ground of administrative exigencies and that the matter, before filing the appeal, was  dealt   with  at   various  levels,   in   the   office   of   the applicant. 3. The   application   is   duly   supported   by   the affidavit of Project Director of the applicant. 4. Whatsoever   alleged   in   the   application, remained uncontroverted, as despite opportunities given to the respondent, the reply has not been filed. 5. Considering the uncontroverted version of the applicant,   which   has   been   duly   supported   by   the affidavit, this Court is satisfied about the existence of sufficient cause, in favour of the applicant, for not filing the accompanying appeal within the prescribed period of limitation. 6. Considering the above facts, application under Section 5 of Limitation Act is allowed, and the delay in filing   the   accompanying   appeal   is   ordered   to   be condoned. The application stands disposed of. Arb. Appeal No. ______ of 2026 7. Vide order of the even date passed in OMP(M) No. 30 of 2026, the delay in filing the appeal has been ordered to be condoned.  Be registered. 8. Application is considered and allowed.  During the pendency of the appeal, which has been admitted, the execution of the award dated 26.07.2022, passed by the   Divisional   Commissioner   Mandi,   exercising   the power of Arbitrator, in case No. 813/2015, is ordered to be stayed, subject to the condition that the applicant shall deposit the entire awarded amount, along with up­ to­date interest, within a period of eight weeks, from today.  The application stands disposed of.  Alteration/ modification/vacation on motion.
