4. FIR No. 80061612/2026 came to be registered on 27.07.2026 at P.S. Sarai Rohilla under Section 305 BNS. The FIR records the allegation of theft of jewellery from the petitioner's residence and indicates that investigation was taken up pursuant thereto.
5. It is the grievance of the petitioner that despite registration of the FIR, the investigation was not proceeding with the requisite promptitude. The petitioner states that he repeatedly approached the concerned police station and also made a representation to the DCP, North District, on 12.08.2026, requesting appropriate directions for a fair and expeditious investigation.
6. The petitioner thereafter approached the learned Magistrate by way of an application under Section 175(3) BNSS seeking monitoring of the investigation. Vide order dated 21.08.2026, the learned JMFC called for a status report from the Investigating Officer/SHO for 30.09.2026.

W.P.(CRL) 2806/2026 application seeking monitoring of the investigation is already pending before the learned Trial Court. It is, however, submitted that the investigation is being conducted in accordance with law.
9. This Court has considered the submissions and perused the material placed on record.
10. It is well settled that the investigation of a cognizable offence is primarily within the domain of the investigating agency. At the same time, the constitutional jurisdiction of this Court can be invoked where circumstances warrant a direction to ensure that an investigation is conducted fairly, effectively and in accordance with law. Such intervention, however, is not intended to take over or supervise the investigation on a day-to-day basis.
11. In the present case, the FIR was registered on 27.07.2026 and the allegation concerns theft of jewellery of substantial value from the petitioner's residence. The petitioner has also placed on record the complaint dated 07.07.2026, the subsequent representation to the DCP, documents relating to the jewellery and other material which, according to him, may be relevant to the investigation.
12. The petitioner has also already invoked the jurisdiction of the learned Magistrate, and a status report has been called for from the Investigating Officer/SHO. Thus, the grievance of the petitioner regarding investigation is not wholly unaddressed. At the same time, having regard to the nature of the allegations, the value of the property allegedly stolen and the requirement of preservation and collection of evidence, this Court considers it appropriate that the investigating agency takes all necessary and effective steps in accordance with law without any avoidable delay.
13. Accordingly, without expressing any opinion on the merits of the This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 16/09/2026 at 13:04:40
