This is an application praying for impleadment of the District Page No.# 3/4 Commissioner, Nagaon and the State Election Commissioner, Assam State Election Commission as respondent/contemnor Nos. 2 & 3 in the connected Contempt Petition (C) No. 25/2024. 3. The applicant has filed the connected Contempt Petition (C) No. 25/2024 alleging violation of this Court’s order dated 28.11.2022 passed in WP(C) No. 5168/2017, wherein the Deputy Commissioner/District Commissioner is arrayed as an alleged contemnor. 4. Mr. Dey, learned counsel for the applicant/petitioner, submits that during the pendency of the contempt petition, the alleged contemnor, Mr. Narendra Kr. Shah, IAS, Deputy Commissioner and Sub-Divisional Planning Officer, Nagaon, Assam, has been transferred and in his place Shri Debasish Sharma, IAS, has been posted as Deputy Commissioner, Nagaon. He further submits that Shri Ranjan Sharma, ACS (Retd.), who is presently the State Election Commissioner, is also a necessary party. Therefore, he prays for impleadment of the aforesaid two incumbents in the connected contempt petition as respondent/contemnor Nos. 2 and 3. 5. Having considered that the earlier incumbent has been transferred from the post of Deputy Commissioner, Nagaon and the present Deputy Commissioner and the State Election Commissioner appears to be necessary party being the alleged contemnors, I deem it appropriate to allow this application. 6. Accordingly, “Shri Debasish Sharma, IAS, Deputy Commissioner, Nagaon, P.O & P.S. Nagaon, PIN-782001, District: Nagaon, Assam” and “Shri Ranjan Sharma, ACS (Retd.) State Election Commissioner, under the Assam State Election Commission, Secretariat, Block-A, 3rd Floor, Dispur, Page No.# 4/4 Guwahati-06”. 7.
