W.P.CRl..(MD).No.1519 of 2026 Prayer : Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records passed by the first respondent in No.652/thaku2/2026 dated 25.02.2026 and quash the same as bad in law and in the nature of writ directing the respondent Nos.1 and 2 to grant emergency leave without escort to the petitioner's brother, namely, Sarath s/o. Ramaraj (C.P.No.5748) (PID No. 65115) who is languishing in the Madurai Central Prison. 2. Heard the learned counsel on either side. 3. The detenu is a life convict, who is presently confined at Madurai Central Prison. The petitioner, who is the brother of the detenu, submitted a representation before the first and second respondents seeking for emergency leave on the ground that the detenu's wife is having serious ailment and that she requires medical treatment. 4. The representation was considered by the first respondent and through the impugned proceedings dated 25.02.2026, the representation came to be rejected on the ground that there is one case pending against the detenu. Aggrieved by the same, the present writ petition has been filed before this Court. 5. It is brought to the notice of this Court that the detenu has undergone imprisonment for four years three months and fourteen days and on eight earlier occasions, he was granted emergency leave with escort.

26.06.2025. 6. In view of the above, just because a case of the year 2017 is pending against the detenu, that cannot be a ground to reject the emergency leave sought for by the detenu, considering the fact that the detenu was granted emergency leave on eight occasions and was also granted ordinary leave on one occasion. 7. In view of the above, the impugned proceedings of the first respondent made in No.652/thaku2/2026 dated 25.02.2026 is hereby set aside and there shall be a direction to the first and second respondents to grant emergency leave to the detenu for a period of six days without escort. The detenu shall report before the fourth respondent daily at 06.00 p.m for the entire emergency leave period. Apart from that condition, the detenu is permitted to submit the sureties before the Superintendent of Prison, Central Prison, Madurai, instead of executing the sureties before the Tahsildar and two sureties shall be the family members of the detenu.
