The petitioners are apprehending their arrest in connection with Huntarganj P.S. Case No. 46 of 2026, for the alleged offences registered under Sections 317(5) and 3(5) of Bharatiya Nyaya Sanhita, 2023, Section 4/21 of the Mines and Minerals (Development and Regulation) Act, 1957, Rule-54 of Jharkhand Minor Mineral Concession Rules, 2004, pending in the Court of learned Judicial Magistrate, 1st Class, Chatra. 3. Learned counsel appearing for the petitioners submits that the petitioner Nos. 1 and 2 are owner and driver respectively of one of the tractor and petitioner Nos. 3 and 4 are also the owner and driver respectively of another tractor and it has been alleged that 100 CFT [2026:JHHC:18858] -2- sand was being carried on each of the tractor. He next submits that the petitioner No. 1 is having one criminal antecedent and petitioner Nos. 2 to 4 are having no criminal antecedent. 4. Learned A.P.P appearing for the State has opposed the prayer and submits that so far as petitioner No. 1 is concerned, he is having three criminal antecedent and further allegations are there of illegally carrying the sand on the tractors in question. 5. Considering that the petitioner No. 1 is having three criminal antecedents, I am not inclined to provide the privilege of anticipatory bail to him. Accordingly, his prayer for anticipatory bail is rejected. 6. So far as petitioner Nos. 2 to 4 are concerned, the petitioner No. 2 is the driver of one of the tractor and petitioner Nos. 3 and 4 are owner and driver respectively of another tractor and they are having no criminal antecedents, I am inclined to provide anticipatory bail to the petitioner Nos. 2 to 4. 7. Accordingly, the petitioner Nos. 2 to 4, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioner Nos. 2 to 4, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Chatra, in connection with Huntarganj P.S.
