This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.26/2026 registered at Police Station – Chakradharnagar, District - Raigarh (C.G.) for the offences punishable under Section 331(6), 296, 351(2), 115(2), 324(4) & 3(5) of the BNS 2023. The prosecution story in brief is that, on 21/01/2026 at around 10.30 pm, the Complainant/ Ravindra Nath Prasad was doing closing work in Ashish Solar Solution Firm office. Feeling hungry, he went downstairs to Anoop Cafe to order Maggi. Near the shop, some people were drinking alcohol and fighting and abusing. Then he stopped them from abusing and told them that they were working in the office upstairs and were getting disturbed by the abuses. Meanwhile, a person attacked him by Holding his collar, he abused him obscenely and threatened to kill him and said that he did not know him, he was Anshu Rajput's brother and said wait I will tell you and he went away from there, the Complainant Ravindra Nath Prasad also went away from there, after some time the applicant, his brother and their companions entered the complainant's office and started beating him with hands, fists and kicks and after holding his collar he was dragged out and beaten by his companions. On the basis of such written complaint of the above incident at Police Station Chakradhar Nagar, a First Information Report vide Crime No. 26/2026 was registered against the applicant and others under sections BNS$ 202 331 (6), 296, 351 (2), 115 (2), 324 (4), 3 (5) of the. In which applicant is apprehending of his arrest. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the aforesaid case. It is further submitted that the present matter arises out of a counter FIR, as on 27.01.2026 the applicant’s side also lodged an FIR bearing Crime No. 27/2026 against the complainant party, namely Ashish Choubey, Ravindranath and another person, alleging that they came to his premises, abused and assaulted him, dragged him upstairs, and that Ashish Choubey burned Ayush Singh’s hand with a cigarette, in respect 3 of which offences under Sections 115(2), 296, 3(5) and 351(2) of the Bharatiya Nyaya Sanhita, 2023 were registered. It is further submitted that the previous criminal cases referred to in the order sheet have already been amicably compromised and disposed of by the learned Trial Court. The applicant is a student and is also employed at Axis Bank, and his arrest would cause irreparable harm to his career, reputation and future prospects. It is also submitted that out of the sections invoked, only Section 331(6) of the BNS (corresponding to Section 458 IPC) is non-bailable, and the ingredients of the said offence are not made out against the applicant. The applicant is a permanent resident of the address mentioned in the cause title, there is no likelihood of his absconding or tampering with prosecution witnesses, and he is ready and willing to abide by all terms and conditions that may be imposed by this Hon’ble Court while granting anticipatory bail. 4. On the other hand, learned State counsel opposes the anticipatory bail application and submits that the applicant has two previous criminal antecedents; therefore, he is not entitled to the grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, submissions of learned counsel for the parties and nature of dispute and materials available on record, without further commenting anything on merits, this Court find it appropriate to grant anticipatory bail to the applicant. 4 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Anshu Rajput, on executing a personal bond and one local surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
