The petitioners are apprehending their arrest in connection with Shikaripara P.S. Case No. 18 of 2024, for the alleged offences registered under Sections 147, 148, 149, 341, 342, 353, 504 and 506 of

the Indian Penal Code, pending in the Court of learned A.C.J.M., Dumka.

Learned counsel appearing for the petitioners submits that the petitioners are not named in the FIR except petitioner No. 6, however, in course of investigation, the name of these petitioners have come. He next submits that the allegations are made that when the C.O. and S.D.O. of Shikaripara (Dumka) were going on, they were stopped by the villagers, however, the allegation of over act is not there against these petitioners. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioners.

Learned A.P.P appearing for the State has opposed the prayer and submits that the allegations are there of stopping the C.O. and S.D.O. of Shikaripara (Dumka).

Considering that except petitioner No. 6, other petitioners are not named in the FIR and only allegations are made against these petitioners of stopping the C.O. and S.D.O. of Shikaripara (Dumka), however, there is no allegation of overt act against these petitioners and in the attending facts and circumstances of the case, I am inclined to provide anticipatory bail to the petitioners.

Accordingly, the petitioners, above named, are hereby
directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Dumka, in connection with Shikaripara P.S. Case No. 18 of 2024, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
