The issue involved in this contempt petition is in respect of committing disobedience of the directions issued by this Court vide order dated 04.09.2024 in D.B. Civil Writ Petition [2026:RJ-JP:4081-DB] (2 of 3) [CCP-631/2025] No.6338/2021, that respondents should take up the issue of considering the Physical Training Instructors (P.T.I.) for promotion to the post of Principal / Vice Principal and shall take a decision on the issue one way or the other. 2. For ready reference, relevant portion of the aforesaid order dated 04.09.2024 i.e. Para Nos.6 & 7, are being reproduced hereunder:- “6. The State has not taken any stand in the matter as yet and the matter is stated to be pending for the last more than 10 years. The dictum of the Supreme Court in the case of P. S. Ramamohana Rao Vs A. P. Agricultural University (supra), does not leave any manner of doubt that the Physical Training Instructors/Physical Teachers are also to be treated as Teachers. Except providing them scale promotions, promotional avenues have not been provided to them and they retire from the post on which they are appointed. As an essential attribute of public employment, it is always expected that one or the other kind of promotional avenues are provided. How and in what manner it is to be provided is in the domain of the State. 7. At this stage, we are of the view that a direction should be issued to the respondents to take a decision on the issue one way or the other.” 3. Learned Additional Advocate General appearing on behalf of the respondents has placed on record a copy of the order dated 21.07.2025 issued by the Commissioner, College Education, Rajasthan, Jaipur, wherein the State Government has taken up the issue and after assigning reasons, have reached to the following conclusion:- “ उपरोक् त से सष है कक राज के राजकीय महाकवदालयों मे कायररत पीटीआई को समय समय पर सकम सर पर कनररय कलया जाकर समुकचत वेतन आकद लाभ पदान ककए गए है। ककं तु आवशक शैककरक अनुभव के अभाव मे एवं कनयमों मे पावधान नहीं होने के कारर पीटीआई को उपाचायर/ पचायर पद पर पदोनत नहीं ककया जा सकता है।" [2026:RJ-JP:4081-DB] (3 of 3) [CCP-631/2025] 4. A copy of the order dated 21.07.2025 has been supplied to counsel for the petitioners. 5. In view of the above, counsel for the petitioners does not dispute that the directions issued by this Court vide order dated 04.09.2024 have been complied with and a decision, vide order dated 21.07.2025, has been taken not to accord any promotion to the PTIs for the promotional post of Principal / Vice Principal, though the scale promotions are being accorded. 6. Learned counsel for the petitioners, in that view of the matter, seeks permission to withdraw this contempt petition with liberty to assail the order dated 21.07.2025 passed by the College Education, in accordance with law. 7. Needless to observe that liberty to the petitioners have already been accorded in the order dated 04.09.2024 itself. 8. Accordingly, the contempt petition is hereby dismissed. 9.
