CORAM: HON'BLE MR. JUSTICE MANOJ JAIN O R D E R % 16.09.2026 1. Petitioner herein has been convicted for committing murder and has been sentenced to undergo life imprisonment. 2. The abovesaid conviction and order on sentence has already attained finality. 3. The petitioner prayed for grant of parole and since his such request for parole, which was sent to the Competent Authority on 10.07.2026, has yet not been decided, the present petition has been filed by invoking writ jurisdiction of this Court with the prayer to grant him parole for four weeks. 4. Learned counsel for petitioner submits that petitioner is eligible for grant of parole as his conduct is recorded as satisfactory. She also submits that twice this year, the petitioner been released on furlough and he never misused the abovesaid liberty, either. 5. Learned Senior Counsel for State submits that as per order dated 03.09.2026, the request of parole had been rejected for the reason that he This is a digitally signed order. The Order is downloaded from the DHC Server on 17/09/2026 at 12:12:49 W.P.(CRL) 2663/2026 2 had availed his furlough lastly from 30.04.2026 to 14.05.2026 and no specific reason has been mentioned, except by averring that he was seeking parole to maintain social ties. 6. Copy of Nominal Roll of the petitioner is enclosed along with the status report which is taken on record and such Nominal Roll indicates the jail conduct of the applicant for last one year as satisfactory. 7. There is nothing to indicate that the petitioner ever misused the concession of furlough on any previous occasion. 8. As per Rule 1212 of Delhi Prison Rules, 2018, the minimum gap between furlough and parole and vice-versa should be of one month. Even when the request of parole was rejected, there was gap of around 3 ½ months. 9. Keeping in mind the facts and circumstances of the case, the present petition is allowed and the petitioner is, hereby, granted parole for a period of four weeks, subject to the following conditions:- (i) The petitioner shall furnish a personal bond in a sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the Jail Superintendent. (ii) Jail Superintendent would be at liberty to get the addresses of the petitioner and his proposed surety verified. (iii) The petitioner shall report to the SHO of the local area, once a week on every Sunday at 10:00 AM and shall not leave the National Capital Territory of Delhi during the period of parole. (iv) The petitioner shall furnish a telephone number to the Jail Superintendent on which he can he contacted, if required. After his release, This is a digitally signed order. (v) Immediately upon the expiry of period of parole, the petitioner shall surrender before the Jail Superintendent. (vi) The period of parole shall be reckoned from the day when the petitioner is released from jail. 10. Present application stands disposed of in aforesaid terms. 11. Pending applications also stand disposed of. 12. A copy of this order be sent to Jail Superintendent for information and compliance.
