Petitioner has filed this writ petition seeking following reliefs. “10.1 That, this Hon'ble Court may kindly be pleased to set aside the impugned order dated 18- 09-2025 passed by the Respondent No.5. (Annexure P/1.) whereby the representation filed by the petitioner was rejected by DEO and Committee. 10.2 That, this Hon'ble Court may kindly further be pleased to direct the respondents authority to grant salary to the petitioner from September 2025 to till PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 3 the date, even after the two recommendation letters issued by the respondent authority the petitioner is serving at his recommended post i.e. Government Higher Secondary School Amakada, Block Durgukodal. facing financial difficulties. 10.3 That, the Hon.ble Court may kindly be issue an appropriate direction to take the decision on the representation of the petitioner within stipulated time by following the process of law and giving opportunity of hearing. 10.4 That, this Hon'ble Court may kindly be pleased to grant any other relief/relief's in favour of the petitioners, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioner.” 2. Learned counsel for petitioner submits that petitioner while working on the post of Lecturer (Economics) in Govt. Higher Secondary School, Aamakda, Block Durdukondal, District Uttar Bastar Kanker has been held to be in surplus and is transferred to Government Higher Secondary School, Farasgaon, Block Narayanpur, District UB Kanker. Against the order of transfer, petitioner has submitted representation before the district level committee which came to be rejected on 18.09.2025. Petitioner thereafter got knowledge that the post of Lecturer (Economics) is not vacant at the transferred place of posting as one teacher is already posted and working. Based on the letter issued by the Principal of Government Higher Secondary School, Farasgaon, petitioner again submitted a representation before the District Education Officer in this regard on which the District Education Officer has recommended to maintain posting of petitioner on earlier place of posting ie., Govt. Higher Secondary School, Aamakda. The letter was written to the Divisional Commissioner-cum-President of divisional level committee under the rationalization policy and further the letter is also forwarded to the Joint Director (Education), Bastar on 10.10.2025. However, till date no further order has been passed with regard to posting of petitioner. As the petitioner is relieved from the earlier place of posting pursuant to the order of transfer under the rationalization policy and was not permitted to join at transferred place due to non availability of vacant post and is also not getting salary, 3 / 3 direction be issued to the Joint Director to pass appropriate orders of posting of petitioner. 3. Learned State counsel submits that in view of limited prayer made by learned counsel for petitioner seeking direction to Joint Director pursuant to the recommendation made by the District Education Officer/ District level committee, she is having no objection. 4. On due consideration of the facts and circumstances of the case, submission of learned counsel for the respective parties, Respondent No. 3/ Joint Director is directed to consider the case of petitioner based on letter dated 10.10.2025 forwarded by the District Education Officer, expeditiously preferably within a further period of 02 weeks from the date of receipt of order passed by this Court. It is also directed that Respondent No. 3 shall also consider claim of petitioner with regard to payment of arrears of salary in accordance with law. 5.
