GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.02.28 14:48:50 +0530 2 2. Case of the prosecution, in brief, is that complainant, Shatrughan Dadsena, lodged a written report at Police Station Saraipali stating that on 25/09/2025 at about 9:00 PM, while he was returning to Harratar from Telidipa along with his friend Uttar Kumar, near Harratar–Telidipa Road, the accused persons—Rohan Yadav, Vinay Kumar Sah, Harishankar Dadsena and Ritesh Patel, residents of Saraipali Road— were standing there. They stopped him and his friend and started assaulting them. It is alleged that applicant Vinay Kumar Sah along with his associates Rohan, Harishankar and Ritesh Patel assaulted him and robbed his mobile phone (Redmi Note 10S) containing a Jio SIM (Mobile No. 8463811970) and cash amount of Rs.4,000/-. They allegedly threw him into a field, assaulted him with stones and threatened to kill him, causing injuries to his legs, hands and waist. His friend Uttar Kumar managed to escape to save his life. On the basis of the said report, Police Station Saraipali registered Crime No. 321/2025 against the accused persons under Sections 126(2), 309(6) and 351(2) of the Bharatiya Nyaya Sanhita, and the matter is under investigation. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case and there is 54 days delay in lodging the FIR and the same has not been explained by the complainant. He would submit that no medical report has been submitted by the prosecution regarding the injuries of the complainant. He would submit that the applicant is young boy aged about 22 years old and there is no previous record against the applicant. He would submit that the applicant is ready to furnish adequate surety and shall abide by all the directions and conditions which may be imposed by this Court, applicant is permanent resident of address mentioned in the 3 cause title and there is no chance of his absconding, therefore he prays to enlarge the applicant on anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the nature of allegation against the applicant that he along with co-accused persons, assaulted the complainant and robbed his mobile phone and cash amount of Rs.4,000/- and also considering the fact that investigation is still going on, therefore I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant - Vinay Kumar Sah, involved in Crime No.321/2025 registered at Police Station Saraipali, District Mahasamund (C.G.) for alleged commission of offence punishable under Sections 126(2), 309(6) & 351(2) of Bhartiya Nyaya Sanhita is rejected.
