Mr. A.I. Patel, Addl. GP a/w. Mr. A.K. Naik, AGP for the State. __________ CORAM: G. S. KULKARNI & DR. NEELA GOKHALE, JJ. DATE: 12 OCTOBER 2026 P.C. 1. We have heard Mr. Kapadnis, learned counsel for the petitioner, for some time and Mr. Patel, learned Addl. AGP, on behalf of the State. 2. Although this petition was filed on 26 December, 2025, we find that the petitioner thereafter filed an additional affidavit in which an entirely new set of documents has been placed on record and new facts have been pleaded. These are not the facts forming part of the petitioner’s main case as set out in the memo of the Writ Petition. In such circumstances, Mr. Kapadnis submitted that the petitioner would withdraw the present petition, with liberty to file a fresh and appropriate petition incorporating all the relevant documents and necessary pleadings in support of the petitioner’s prayer. 3. Considering the interests of justice, we permit the petitioner to withdraw 12 October 2026 2026:BHC-AS:41425-DB 14.WP2980_2026.DOC this petition, with liberty to file a fresh petition.
