After arguing for a while, learned counsel for the petitioner submits that the petitioner would feel satisfied, in case the respondent No. 2 and 5 are directed to treat the instant writ petition as representation and are directed to accord due consideration to the same within some reasonable time, to which, Ms. Priyanka Bhat, Assisting Counsel, who has caused appearance on behalf of respondent Nos. 2 to 5 vice Mrs. Monika Kohli, Sr. AAG, is not averse provided the same is directed to be accorded consideration strictly under rule and as per law. 03. With the consent of learned counsel for the parties and keeping in view the facts and circumstances of the case, the instant writ petition is disposed of, at the threshold, with a direction to the respondent No. 2 and 5 to consider the claim of the petitioner by treating this writ petition as representation and take a decision thereon strictly under rules and as per law and pass a S. No. 180 2 WP(C) No. 612/2026 consideration order within a period of six weeks from the date a certified copy of this order alongwith complete set of writ petition are made available to the said respondents. Needless to say that the consideration shall be accorded strictly in consonance with the law laid down by this Court in case titled M/s Saint Soldier Engineer and contractor Pvt. Ltd vs UT of J&K & Ors, decided on 26.09.2025[WP(C) No. 2472/2022]. 04. While according consideration, the respondents 2 and 5 shall give due weightage to the communication dated 10.03.2022 (Annexure-V) which has been placed on record by the petitioner which has been addressed by the concerned Executive Engineer PWD R&B, a perusal whereof reveals that the respondents have admitted the liability towards the petitioner wherein the petitioner has already completed the works and the workdone claim of CC 1st Bill amounting to Rs.2,05,600/- is being payable as on date to the petitioner as the petitioner has already submitted the requisite bills in this regard which have been forwarded by the appropriate authority. The order of consideration which is likely to be passed, be forwarded to the petitioner through registered post. 05. Disposed of the in the manner indicated above.
