Learned counsel for respondents No.2 to 5 submits that this writ petition has rendered infructuous. He further submits that this writ petition is filed challenging the proceedings of mutation, wherein application submitted by petitioner for mutating his name based on the Will has been rejected. Suit filed by the petitioner claiming title based on will also came to be dismissed and appeal is pending. 2. Learned counsel for petitioner do not dispute the submission of learned counsel for respondents with regard to the facts and events as submitted. He further submits that in view of the submission made by learned counsel for respondents, he may be permitted to withdraw this writ petition with liberty to file appropriate proceedings if appeal is decreed in his favour. 3. In view of above submission made by learned counsel for respective parties, this writ petition is dismissed, reserving liberty with petitioner to file appropriate proceeding based on the subsequent order and decree, if passed in his favour.
