Learned advocate appearing for the petitioner draws the attention of the Court to paragraph 11 of the charge sheet submitted. He submits that, in the charge sheet it is alleged as against the petitioner that the commercial quantity of contraband seized belonged to one person and that one of accomplishes of such person is the petitioner. 3. The contraband was seized from a vehicle. Vehicle does not belong to the petitioner. Petitioner was not arrested along with the contraband. 4. Petitioner is sought to be roped into the police case on the basis of statement made by a co-accused while in custody. Court’s attention is not drawn to any evidence implicating 2 the petitioner with the seized commercial quantity of contraband. 5. In such circumstances, the Court is of the view that the petitioner is able to overcome the restrictions under Section 37 of the NDPS Act. 6. Consequently, petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Special Judge under NDPS Act, Cooch Behar. The petitioner shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever. 7. In the event, the petitioner fails to comply with the conditions as enshrined hereinbefore, it is open to the trial court to cancel the bail without further reference to this Court. 8.
