JUSTICE R.K. PATTANAIK Order No. ORDER 19.05.2026 02. 1. The ABLAPLs are taken up together and disposed of by the following order. 2. Instant petitions have been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Rasgovindpur PS. Case No. 206 of 2026 corresponding to C.T Case No. 200 of 2026 pending in the Court of learned JMFC, Rasgovindpur the grounds stated. 3. Perused the F.I.R. as at Annexure-1. Recorded the submissions of learned counsel for the respective parties. It is informed to the Court that for the self-same incident, two other F.I.Rs. are registered as Rasgovindpur P.S. Case Nos. 204 & 205 of 2026 along with the present one. The submission is that in the other two cases, some of the accused persons have been granted bail pursuant to the orders in ABLAPL Nos. 4846, 4931, 4938 & 4961 of 2026. It is submitted that the petitioners are similarly situated considering the allegations in the F.I.R. It is claimed that the petitioners allegedly found to be the members of a mob which was involved in an agitation. The details of the incident for which the mischief was committed by the accused persons stand revealed in the F.I.R. The Court finds that the petitioners committed the overt acts during the agitation which later on turned violent. But having regard to the p. 3 fact that the petitioners are on the equal footing like the other accused persons in the connected cases, recording the objection of the State and the claim that no one is having any antecedent of similar nature, this Court is inclined to direct them to surrender before the learned court below for being released instead of entertaining their bail plea as is advanced. 4. Accordingly, it is ordered. 5. In the result, the ABLAPLs stand disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the learned J.M.F.C., Rasgovindpur within a fortnight from today in connection with Rasgovindpur P.S.
