Shastri, A.P.P. ------ 04/ 25.06.2026 Heard learned counsel for the petitioners and learned A.P.P for the State. 2. The petitioners are apprehending their arrest in connection with Radhanagar P.S. Case No. 180 of 2022, for the alleged offences registered under Sections 175 and 379 of the Indian Penal Code, Section 21(1)/21(6) of the Mines and Minerals (Development and Regulation) Act, 1957 and Rule-4/54 of Jharkhand Minor Mineral Concession Rules, 2004, pending in the Court of learned Judicial Magistrate, 1st Class, Rajmahal. 3. Learned counsel appearing for the petitioners submits that both these petitioners happened to be the owners of two different tractors and it has been alleged that 100 CFT sand was being carried on each of the tractors. She next submits that in the similar circumstance, the other co-accused persons has already been provided the privilege of anticipatory bail in A.B.A. No. 9289 of 2022 by the co-ordinate bench of this court. She further submits that the petitioners are having no [2026:JHHC:18703] -2- criminal antecedent and disclosure to that effect has been made in para- 10 of the petition. 4. Learned A.P.P appearing for the State has opposed the prayer and submits that illegally the sand was being carried on the tractors in question. 5. Considering that both these petitioners are the owners of two different tractors and further they are having no criminal antecedent and disclosure to that effect has been made in para-10 of the petition and in the similar circumstance, the other co-accused persons have already been provided the privilege of anticipatory bail in the aforementioned A.B.A. by the co-ordinate bench, I am inclined to provide anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Rajmahal, in connection with Radhanagar P.S.
