1. The present Application has been filed on behalf of the Plaintiff under
Order XXIII Rule 3 read with Section 151 of CPC, for passing a decree in terms of the settlement arrived at between the Parties vide a Settlement Agreement dated 24.08.2026 (hereinafter referred to as “Settlement Agreement”). 2. The present Suit is one for declaration and injunction in respect of the Property bearing No. N-24, situated at Green Park Extension, New Delhi- 110016, measuring 30feet x 80feet, i.e. 2400 Sq. Ft. 3. During the pendency of the present Suit, the Parties were referred to the Delhi High Court Mediation and Conciliation Centre. The Parties have entered into a settlement vide the Settlement Agreement. The Settlement Agreement is reproduced as under: This is a digitally signed order. 4. The Parties have joined the proceedings through video conferencing and they have been identified by their respective Counsels. The Settlement Agreement has been signed by all the Parties. This Court has gone through the Settlement Agreement, the terms of which are legal and lawful and, therefore, the ingredients of Order XXIII Rule 3 of CPC are satisfied. 5. In view of the fact that the Settlement Agreement has been signed by all the Parties, having been entered by the parties without any undue influence and coercion, and the Parties have read and understood the contents of the Settlement Agreement, the Suit is disposed of and decreed in terms of the Settlement Agreement entered into between the Parties. 6. The Parties shall be bound by the terms of the Settlement Agreement.
The Parties undertake that they would not deviate from the Settlement Agreement and would co-operate to ensure that the Settlement Agreement is implemented. 7. Let the decree sheet be drawn up accordingly. 8. Since the Parties have entered into the Settlement Agreement, the Plaintiffs are entitled to a refund of court fees in terms of Section 16 of the Court Fees Act, 1870.
