This is an application filed by the present applicant under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’), seeking grant of anticipatory bail in FIR No. 60/2026 for the offences punishable under Sections 21 and 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as NDPS Act), registered at Police Station, Crime Branch, New Delhi.

Learned counsel for the applicant submits that interim protection was granted by the Learned Trial Court on several dates, and the applicant joined the investigation; however, subsequently, no notice was received by her, and therefore, she did not join the investigation.

Learned counsel for the applicant further submits that the applicant is a lady having a child aged 5 years, and she is ready to join the investigation as and when directed by this Court. There is no evidence against her, and the allegations against the present applicant surfaced only in the disclosure statement of the co-accused, Muskan. She has no connection with any of the co-accused persons. 7. Per contra, learned APP for the State submits that, though in the anticipatory bail application filed before the Learned Trial Court, the applicant has stated that she has no connection whatsoever with the co- accused persons, Muskan and Gungun; however, the CDR records tell otherwise. She was constantly in contact with co-accused Muskan, and the cell phone locations also depict that she met with the said co-accused Muskan several times, but she has consistently denied the same. 8. Learned APP for the State further submits that, even during the investigation, she did not cooperate properly and also denied having any mobile phone, stating that she does not know how to operate one. She has also denied her Instagram account and stated that it is a fake account created by someone else and does not belong to her. 9. Learned APP for the State submits that, to ascertain the complete chain of supply of the contraband, and since substantial digital evidence has come on record against the applicant, her custodial interrogation is necessary. Therefore, her anticipatory bail is strongly opposed. 10. This court has heard the contentions of both the parties. 11. Although at present, no recovery was effected from the applicant, the fact remains that her name has been disclosed by the co-accused Muskan in the disclosure statement. Further, her CDR record indicates that she was in constant contact with the other co-accused persons and had also met them. Therefore, in order to ascertain the complete chain of supply of the contraband, as well as the other members of the syndicate, custodial interrogation of the applicant is considered necessary. 12.
Having regard to the facts and circumstances of the case, at present, no ground for grant of anticipatory bail is made out in favour of the applicant. Accordingly, the present bail application is dismissed. Pending application(s), if any, also stand disposed of. 13. The order be uploaded on the website forthwith.
