The petitioner is apprehending his arrest in connection with Dumri P.S. Case No. 36 of 2023, registered for the offence under Sections 147, 149, 341, 323, 324, 307, 427 and 506 of the Indian Penal Code, pending in the court of learned ACJM, Giridih.

Learned counsel appearing for the petitioner submits that the altercation took place due to previous enmity and even the allegation of making assault is there, however, there is no injury. He next submits that in the similar circumstance, the other co-accused person has already been provided the privilege of anticipatory bail in A.B.A. No. 3364 of 2025 by the co-ordinate bench. He further submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-14 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of making assault.

Considering that the allegations are there of making assault, however, injury is not found and further in the similar

circumstance, the other co-accused person has already been provided the privilege of anticipatory bail in the aforementioned A.B.A. by the co-ordinate bench and the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-14 of the petition, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Giridih, in connection with Dumri P.S. Case No. 36 of 2023, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
