The present application has been filed under Section 438 of the Code of Criminal Procedure, 1973 read with Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking anticipatory bail in FIR No. 44/2026, registered at P.S. Tilak Marg, New Delhi, under Sections 132/195/221/223A/61/232/326(G)/35 of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’), and Section 4 of the Prevention of Damage to Public Property Act, 1984. 3. Learned counsel for the petitioner submits that the petitioner has been cooperating with the investigation pursuant to the interim protection granted by this Court vide order dated 03.06.2026. It is submitted that the petitioner has joined the investigation as and when called by the Investigating Officer and has duly cooperated with the investigation. This is a digitally signed order. Learned APP for the State, on instructions from the Investigating Officer, submits that the petitioner has joined the investigation and has cooperated with the Investigating Officer. It is further submitted that the petitioner is not required for any custodial interrogation at this stage. 5. In view of the aforesaid facts and circumstances, the interim protection granted to the petitioner vide order dated 03.06.2026 is made absolute, subject to the petitioner being released on anticipatory bail in the event of his arrest in FIR No. 44/2026, on furnishing a personal bond in the sum of Rs.25,000/- with two sureties of the like amount to the satisfaction of the concerned SHO/Investigating Officer, subject to the following conditions: i. The Applicant shall remain available on mobile numbers; shared by him with the Police. ii. The Applicant shall not leave NCT of Delhi without prior permission of the concerned IO/SHO. iii. The Applicant shall not directly or indirectly make an attempt to influence the witnesses or tamper with the evidence in any manner. iv. In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned I.O/SHO. 6. Copy of the order be communicated to the concerned Jail Superintendent and the learned Trial Court for necessary information and compliance. 7. The application stands disposed of in the above terms.
